Please read these Terms of Service ("Terms") carefully before using the SnoreCheck app ("the App") operated by SharkEar ("we", "us", or "our").
By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.
SnoreCheck is a sleep monitoring application that uses on-device audio analysis to detect snoring and provide sleep quality insights. The App is intended for informational and wellness purposes only.
The App is not a medical device and is not intended to diagnose, treat, cure, or prevent any medical condition, including but not limited to sleep apnea, insomnia, or other sleep disorders. The information provided by the App (including Quiet Sleep Scores, trend data, and event detection) is for general informational purposes only and should not be relied upon as medical advice. Always consult a qualified healthcare professional for medical concerns.
While we strive for accuracy, the App's snore detection relies on machine learning models that may produce false positives or miss events. Results may be affected by microphone quality, phone placement, ambient noise, and other environmental factors. We do not guarantee the accuracy, completeness, or reliability of any analysis or score provided by the App.
The App, including its code, design, machine learning models, visual assets, and content, is the property of SharkEar and is protected by applicable intellectual property laws. You may not copy, modify, distribute, reverse-engineer, or create derivative works of the App.
Your use of the App is also governed by our Privacy Policy. All data remains on your device as described therein.
To the fullest extent permitted by applicable law, SharkEar shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising out of or related to your use of the App. Our total liability for any claim shall not exceed the amount you paid for the App.
The App is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
We reserve the right to discontinue or modify the App at any time without notice. You may stop using the App at any time by uninstalling it.
We may revise these Terms at any time. Continued use of the App after changes constitutes acceptance of the revised Terms.
These Terms shall be governed by and construed in accordance with the laws of Romania, without regard to conflict of law principles.
